1. Agreement to These Terms
These Terms and Conditions govern your access to and use of the AsapChop website, mobile application, ordering platform, delivery services, and related features.
In these Terms, “AsapChop”, “we”, “us”, or “our” refers to AsapChop. “You” or “your” refers to the person accessing or using the platform. “Vendor” refers to a restaurant, pharmacy, shop, store, retailer, or other participating business. “Delivery Partner” refers to an independent or authorised person responsible for collecting and delivering an order or parcel.
By registering for an account, accessing the platform, placing an order, requesting a delivery, or using any AsapChop service, you agree to comply with these Terms and our Privacy Policy.
If you do not agree to these Terms, you must not use the AsapChop platform.
2. Eligibility and Account Registration
You must provide accurate, current, and complete information when creating or using an account. You are responsible for updating your information whenever it changes.
You are responsible for maintaining the confidentiality of your account credentials and for all activities carried out through your account. You must notify AsapChop promptly if you believe your account has been accessed without authorisation.
You must not create an account using another person’s identity, provide false information, operate multiple accounts for abusive purposes, or allow another person to use your account in a manner that violates these Terms.
3. AsapChop’s Role
AsapChop operates a technology platform that helps customers discover participating vendors and request delivery services. Depending on the service, AsapChop may facilitate communication, order processing, payment, delivery coordination, and customer support.
Products are supplied by participating vendors, and delivery services may be performed by Delivery Partners. Product availability, preparation, packaging, quality, ingredients, expiry dates, and compliance with applicable product requirements remain the responsibility of the relevant vendor unless otherwise stated.
AsapChop does not guarantee that every vendor, product, service, delivery route, or feature will be available at all times.
4. Orders and Product Information
When you place an order, you are making a request to purchase available products or services from the selected vendor. An order is accepted only when it has been confirmed through the platform or by an authorised AsapChop representative.
Product images, descriptions, menus, prices, availability, portions, colours, packaging, and other information may be provided by vendors and may change without notice.
We will make reasonable efforts to display accurate information. However, minor variations may occur, and a requested item may become unavailable before or after an order is placed.
If an item is unavailable, the vendor or AsapChop may contact you regarding a replacement, adjustment, partial cancellation, or refund, subject to the applicable circumstances.
5. Prices, Fees, and Taxes
The total amount payable may include the product price, delivery fee, service fee, platform fee, applicable taxes, surcharges, packaging charges, or other charges shown during checkout.
Prices and fees may vary according to vendor, distance, location, demand, time, order size, delivery method, promotions, and other operational factors.
You are responsible for reviewing the order summary before confirming payment. Once an order is confirmed, changes to the order may not be possible.
6. Payments
You must use a valid and authorised payment method. By submitting payment information, you confirm that you are authorised to use the selected payment method.
Payments may be processed by third-party payment providers. AsapChop may decline, cancel, or place a transaction on hold where there is suspected fraud, payment failure, insufficient authorisation, technical difficulty, or another legitimate reason.
Where an amount is refunded, the time required for the funds to appear may depend on the payment provider or financial institution.
7. Delivery
Delivery availability depends on the delivery location, service area, vendor availability, operating hours, road conditions, weather, traffic, public events, security conditions, and the availability of Delivery Partners.
Any delivery time displayed on the platform is an estimate and not a guaranteed deadline. Delays may occur because of vendor preparation time, traffic, weather, inaccurate delivery information, customer unavailability, payment issues, or circumstances outside our reasonable control.
You must provide an accurate delivery address, telephone number, landmark, and any relevant delivery instructions. You are responsible for ensuring that the delivery location is reasonably accessible and that someone authorised is available to receive the order where required.
8. Medicine and Health-Related Orders
Medicine and pharmacy orders are subject to availability, vendor requirements, applicable law, and any prescription or verification requirements. AsapChop is not a doctor, pharmacist, hospital, or healthcare provider and does not provide medical advice.
You should consult a qualified healthcare professional regarding diagnosis, treatment, dosage, allergies, drug interactions, and other medical questions.
AsapChop and Delivery Partners may refuse or delay an order where verification, prescription documentation, product eligibility, or safe delivery requirements cannot be satisfied.
9. Parcel Delivery
You must accurately describe parcels and must not request delivery of prohibited, dangerous, illegal, hazardous, stolen, counterfeit, or improperly packaged items.
Prohibited items may include weapons, explosives, illegal drugs, dangerous chemicals, flammable substances, stolen goods, live animals, and any item prohibited by applicable law or AsapChop policy.
AsapChop may refuse, inspect, suspend, or cancel a parcel request where there is a safety, legal, security, packaging, or serviceability concern.
10. Customer Responsibilities
You agree to:
- Use the platform lawfully and honestly.
- Provide accurate account, order, payment, and delivery information.
- Treat vendors, Delivery Partners, support staff, and other users respectfully.
- Receive orders promptly and provide reasonable assistance at the delivery location.
- Review orders and report problems within a reasonable time.
- Protect your account credentials and devices.
- Not interfere with the operation, security, or integrity of the platform.
- Not use the platform for fraud, abuse, harassment, reselling, or unlawful activity.
11. Prohibited Conduct
You must not:
- Access or use the platform for an unlawful purpose.
- Submit false, misleading, fraudulent, or malicious information.
- Attempt to obtain products, refunds, credits, or services through deception.
- Reverse engineer, copy, modify, or interfere with the platform.
- Use automated systems to scrape, overload, or improperly access the platform.
- Upload malicious code or content.
- Impersonate another person, business, vendor, Delivery Partner, or AsapChop representative.
- Use another person’s payment method without authorisation.
12. Promotions and Credits
Promotional codes, discounts, wallet credits, loyalty benefits, and special offers may be subject to additional terms, expiry dates, usage restrictions, minimum order values, geographic restrictions, and account limitations.
Promotions may not be combined unless expressly stated. AsapChop may cancel or withdraw a promotion where misuse, fraud, technical error, or ineligibility is suspected.
13. Reviews and User Content
You may be able to submit ratings, reviews, comments, photographs, or other content. You must ensure that your content is accurate, lawful, respectful, and does not infringe another person’s rights.
By submitting content, you grant AsapChop a non-exclusive, royalty-free, worldwide licence to host, reproduce, display, adapt, and use the content for operating, improving, promoting, and providing the platform, subject to applicable law.
We may remove content that is abusive, unlawful, misleading, defamatory, discriminatory, fraudulent, or otherwise inappropriate.
14. Intellectual Property
The AsapChop name, logos, designs, software, platform features, text, graphics, photographs, trademarks, and other materials are owned by or licensed to AsapChop and are protected by applicable intellectual property laws.
You may use the platform only for personal or authorised business purposes. You may not copy, reproduce, distribute, sell, modify, or commercially exploit AsapChop materials without written permission.
15. Suspension and Termination
We may suspend, restrict, or terminate access to an account or service where we reasonably believe that you have violated these Terms, engaged in fraud or abuse, created a safety risk, failed to pay an amount due, or used the platform in a way that may harm AsapChop, vendors, Delivery Partners, or other users.
You may stop using the platform at any time. Provisions that by their nature should continue after termination, including payment obligations, intellectual property, disclaimers, liability limitations, and dispute provisions, will continue to apply.
16. Disclaimers
The platform and services are provided on an “as available” basis. To the extent permitted by applicable law, AsapChop does not guarantee that the platform will always be uninterrupted, error-free, completely secure, or available in every location.
We do not guarantee that every product, vendor, menu, pharmacy item, store item, delivery route, or service will always be available or suitable for your specific needs.
17. Limitation of Liability
To the maximum extent permitted by applicable law, AsapChop will not be responsible for indirect, incidental, special, consequential, exemplary, or punitive losses arising from your use of the platform or services.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law. Specific liability provisions may also apply to vendors, payment providers, and Delivery Partners.
18. Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless AsapChop, its officers, employees, affiliates, contractors, vendors, and Delivery Partners from claims, losses, liabilities, damages, costs, and expenses arising from your breach of these Terms, misuse of the platform, unlawful conduct, or violation of another person’s rights.
19. Changes to These Terms
We may update these Terms from time to time. Updated Terms will be published on the platform with a revised effective date. Your continued use of AsapChop after an update means that you accept the updated Terms.
20. Governing Law and Contact
These Terms shall be governed by the laws of The Republic of Cameroon. Any dispute shall be handled by the courts or dispute-resolution forum with appropriate jurisdiction, subject to applicable law.
